New Ontario Estate Forms
Subscribers involved in estate administration are reminded that, pursuant to Ontario Regulation 653/00, the following changes to the estate forms are effective from March 1, 2001.
First, Form 74.3 (Request for Notice of Commencement of Proceeding) and Form 75.5 (Notice of Application for Directions) have been revised by striking out the words "I have a financial interest in the estate" and substituting the words "I have or appear to have a financial interest in the estate".
Second, three new forms have been added:
- Form 74.4.1, Application for Certificate of Appointment of Estate Trustee with a Will (Individual Applicant) Limited to Assets Referred to in the Will
- Form 74.5.1, Application for Certificate of Appointment of Estate Trustee with a Will (Corporate Applicant) Limited to Assets Referred to in the Will
- Form 74.13.1, Certificate of Appointment of Estate Trustee with a Will Limited to Assets Referred to in the Will
Form 74.27 (Application for Confirmation by Resealing of Appointment or Certificate of Ancillary Appointment of Trustee) has been revoked and replaced by new Form 74.27.
Finally, Form 75.5 (Notice of Application for Directions) has been revised by striking out the words "as soon as possible, but not later than 2 p.m. on the day before the hearing" and substituting "as soon as possible, but not later than two days before the hearing".
